1. Who We Are
Captionator AI (“Captionator,” “we,” “our,” or “us”) is headquartered in Atenas, Alajuela, Costa Rica and provides cloud-based software that analyzes, classifies, and documents users’ media files. We are committed to protecting your privacy and treating your data responsibly. This Privacy Policy explains how we collect, use, disclose, and protect information when you use our applications, websites, and related services (the “Services”).
2. Scope
This Policy applies to all users of the Services worldwide. Separate agreements—such as our Terms & Conditions or enterprise data-processing addenda—may supplement or modify certain provisions below.

Important: Captionator’s core function is to store and process your media files and the metadata we generate from them. This information is retained on our systems (see Section 8) but will not be sold to third parties (Section 6).

5. Model Training & Analytics
By default, Captionator may use your data (including media and metadata) to train, fine-tune, or evaluate our machine-learning models that power search, tagging, and other features. If your subscription tier specifically restricts model-training usage, we will exclude your data from future training runs. You may also email compliance@captionator.ai to request exclusion, though this may limit certain functionality.

No Sale of Data: We do not sell your personal or media data to third-party companies for their independent marketing or advertising purposes, unless explicitly stated in an agreement that you accept.
7. Cookies & Tracking Technologies
We use cookies, local storage, and similar technologies to authenticate sessions, remember preferences, and measure performance. Essential cookies are required for core functionality, but you may control other cookies through your browser settings.
8. Data Retention
We retain information only as long as necessary to provide the Services, comply with legal obligations, resolve disputes, and ensure security. When retention is no longer required, we delete or anonymize data in accordance with industry standards.
9. Security
We employ administrative, technical, and organizational measures—including encryption in transit and at rest, role-based access controls, regular penetration testing, and incident-response procedures—to protect information against unauthorized access or loss. No system is completely secure; you are responsible for safeguarding your credentials.
10. Your Rights & Choices
- EU / UK GDPR: Access, rectify, erase, restrict, portability, object, lodge complaint
- California CCPA/CPRA: Know, delete, correct, opt out of sale/share (not applicable), limit sensitive data
- Global: Withdraw consent where processing is based on consent
To delete your data, email compliance@captionator.ai with “Data Deletion Request” in the subject line. We will verify your identity and erase data (subject to legal retention requirements) within 30 days.
11. International Transfers
Although Captionator AI operates from Costa Rica, all user data is currently stored on servers located in the United States . When transferring personal data from the European Economic Area, United Kingdom, or Switzerland, we rely on lawful mechanisms such as Standard Contractual Clauses or an adequacy decision.
12. Children’s Privacy
Captionator AI is not directed to children under 13. We do not knowingly collect personal data from children. If you believe a child has provided us with personal information, contact us immediately at compliance@captionator.ai.
13. Changes to This Policy
We may update this Privacy Policy periodically. Material changes will be announced by email or a prominent notice on the Service, and the “Last updated” date will change accordingly. Continued use of the Services after updates constitutes acceptance of the revised Policy.
